Consent To Establish

Navigating environmental regulations is crucial for the success of any project. Consent to Establish (CTE) is an essential approval from the Maharashtra Pollution Control Board (MPCB) for setting up or expanding a project. This ensures that your project complies with environmental standards to prevent and control pollution.

Consent to Establish is the approval granted by the MPCB for the establishment of new projects or the expansion and modification of existing ones. This approval is mandatory under the Water (Prevention and Control of Pollution) Act, 1974, and the Air (Prevention and Control of Pollution) Act, 1981. It signifies that the proposed project meets the environmental regulations and standards set by the MPCB, ensuring the control and prevention of pollution.

There are four types of consent:

  • Simplified Consent (for pollution-free small-scale industries)
  • Green Consent
  • Orange Consent
  • Red Consent

The No Objection Certificate (NOC) is valid for one year. If the unit is not operational within this period, the NOC must be renewed. If a renewal is not requested within the validity period, a new application must be submitted to the Pollution Control Board.

Tasks involved in obtaining Consent to Establish from the Maharashtra Pollution Control Board (MPCB) include:

  • Coordinating, managing, and application process for Consent to Establish.
  • Representing the organization during MPCB visits and meetings.
  • Completion of application forms for water, air, and hazardous wastes.
  • Compiling necessary documentation and preparing attachments for the application.
  • Submitting consent forms and relevant data to the MPCB in triplicate.
  • Ensuring timely follow-up with the concerned department to expedite application processing.
  • Securing Consents to Establish for water, air, and solid/ hazardous wastes.
  • Facilitating communication and coordination with the MPCB throughout the consent acquisition process.
  • Obtaining the Consent to Establish from MPCB.

Documents Required:

  • Project report
  • Land documents
  • Site plan and layout plan
  • Detailed manufacturing process
  • Water budget
  • Air pollution control measures

Consent to Establish (CTE) is a prerequisite for any industry or project to begin construction or setup operations, ensuring compliance withvenvironmental regulations.

Submit the CTE application through the MPCB’s online portal, compile and submit the required documents, pay the applicable fees, and await the site inspection and approval.

“Consent to Establish” is generally mandated by environmental and pollution control laws enforced by government authorities. These regulations require that projects or activities with potential environmental impacts secure official approval prior to commencement, ensuring adherence to established standards and protective measures.

Obtaining consent is crucial to ensure that projects or activities are conducted responsibly and in accordance with regulations, reducing potential adverse effects on the environment, public health, and safety. It allows regulatory authorities to evaluate, oversee, and manage different aspects of the project, promoting sustainable development and the responsible use of resources.
